The only "valid" argument is the volume one.

Say someone figure out how to use water pipes to deliver both Coke and Water. Say you just paired for the pipes regardless of what was delivered. Now water is a necessity that is vital for many purposes like washing stuff, watering plants and pets (this is like applying for a job online, staying informed, banking, social interaction etc.) Coke on the other hand is something lots of people like to drink (this is like porn and streaming movies).

If in the above scenario there is so much coke being pumped through the system that the pipes can barely handle it and it is limiting the spread of water we have a problem. The only solution is to either make Coca-Cola pay more to put their Coke in the pipes so people want less coke or to increase the size of the pipes.

Are we at the point where Netflix and Pornhub are bogging down banking, applying for jobs and research sites? I would say no. I would bet the design of a website has way more impact than the flow of information thought the pipes at this point (lots of ads means a slower site) Additionally we are not talking about a Water utility that is acting in the public good. We are talking about IP's and if they can get more money by charging Banks, Governments, and Job sites more for faster access they will. In fact Amazon, Google and the like may even be able to get better deals due to scale leaving small fry to pay more.

Should the necessitates of the Internet get priory (like water)? Yeah and currently medical traffic does. Should popular sites be slowed down, because they are popular and the IPS can shake them down? That is not the free market deciding, that is a Private companies acting as regulators. I'm not sure why republicans prefer private regulators to government regulators but there we have it.
