Re: Patent No. US D536,391
Copyright protection, if there is any, should be the only concern.

Re: Patent No. US D536,391
For the name?
The last I knew someone had purchased the copyright to the Heroscape name awhile ago. Not sure how legit that was but I was in contact with them for a bit. |

Re: Patent No. US D536,391
Wonder if they’ll be able to get it from Isak.
C3G can be played with official Heroscape, but it's not recommended.

It wasn’t my sense he intended to try to capitalize on it. If the time comes, I think arrangements would not be difficult.

Re: Patent No. US D536,391
But what about the patent. Registering the trademark wouldn't stop anyone from making the terrain to sell on its own. They just couldn't use the trademark.

If you look at the history of Trademark Holders you can see Isak's history.
Under his Filing History you'll find: Code:
CANCELLATION INSTITUTED NO. 999999 2021-02-2212 PETC T:TTAB Proceeding My Custom Designs.

Re: Patent No. US D536,391
Thanks
@Leaf_It
. From that link it looks like Hasbro re-filed for Trademark on 2/11/21, the day BEFORE I posted here - if it was the same day I'd find it fishy, now makes me think like since Terrain Patents expired they want to reuse the name.

Re: Patent No. US D536,391
I'm behind on this discussion, but I just finished up studying patent law, and I'm pretty confident in the following statements:
Once a patent is dead, it's dead. CVN can't buy the patent, nor can Hasbro renew it. Anyone should be able to produce HeroScape terrain. The only concerns would come from trademarks and copyrights at this point. The Isak thing is weird, but it looks like Hasbro is trying to reclaim the trademark. TLDR: nothing has changed for Hasbro, but anyone should be able to legally produce terrain now. Casters of Valhalla: THE Competitive HeroScape Podcast!

I have a feeling it's just to give them legal power in case anyone were to try to sell the terrain using the HeroScape TM. Although, you never know, maybe they will try to rebrand the game in a cheaper way. |
