I think this topic was back from the HQ days, but I got a response (as seems to be the flavor of today :D YAY!) from Hasbro about this. Here's the email text.

Hi Scott,

Thank you for contacting Hasbro previously with your question on Heroscape! I sincerely apologize for the delay in my response, but I now have an official answer to your question.

To refresh your memory, your pending question was in regards to optional abilities.

Normally, the words "May" or "Must" are used to illustrate optional v. s. must-use powers. However, there are certain figures that do not clarify that point. They would be determined optional on a case by case basis.

You pointed out Thorgrim & Finn's Spirit powers. Both of those powers are confirmed as optional abilities.

Aahh! Good to know.

From the official site:
Finn the Viking Champion
Attack Aura 1
All friendly figures adjacent to Finn with a range of 1 add 1 die to their normal attack.

Warriors Attack Spirit 1
When Finn is destroyed, place this figure on any unique Army Card. Finn's Spirit adds 1 to the normal attack number on that card.
When Finn dies, if you have no Unique Army Cards but your opponent has, you do not HAVE to place Finn on their army card.

Correct (and I do believe that was the context of why I asked the question, if I recall correctly anyway)
