Anyways I was cruisin Ebay this morning when I came across a custom card. I instantly recognized it as one of Annerio's. I asked Annerios if it was his and as a matter of fact it is not. This dirtbag stole the card. I have seen this happen before but I still left him a nasty comment. I am almost willing to try and win this custom just so I can leave him a nasty feedback. Anyways here he is if you want to talk to him :twisted:

If I ever see one on ebay though I will do everything I can to harrass you for life. If I can find your email, I will have your power turned off, sign you up for every mailing list I can find and whatever else I can think of. Ok. The story goes a little deeper. The name sounded slightly familiar. I talk to various people via PM regarding advice making custom figures and don't think much of it. I went back in my PM's and noticed this Scorpio2525 that had messaged me regarding where to get figures to make certain characters.

This guy may just be mining the community to make a profit and that is seriously uncool. :bs:

He has modified the card since again with info from this site and that is protected by the copyright blurb. The original card was probably from HS.net or HQ. This character has been around that long.

My wife sells on eBay and they WILL kill auctions and ban sellers who violate others rights and copyrights. It has happened many times. For example, someone registered the term "shabby chick" (apparently it is a style). Whenever anyone posts an auction with that in the description, eBay kills it as the person who registered it (also an eBay seller) enforces her rights. Annerios should contact eBay and complain.

I contacted E-bay to see if they will shut down the auction and clearly pointed out Heroscapers.com policy about the materials on this site, etc. We shall see. . .

I agree with you guys. It is terribly wrong for someone to EVER steal someone elses ideas then try and make a profit. Sadly, people are not always the kindest they could be. This being one of those examples.

However I am still concerned. If this guy really is in it just for the money, then being banned will most likely not stop him by a long shot. Is his account banned? Or is his computer banned? Because I was wondering, if you are not signed in can't you still view cards and stuff? If yes, then couldn't the mods make it so that ONLY members are aloud to view them. That way they could cut down on those that are banned and still want to continue doing what they want.

Stealing other people's property, intellectual or otherwise, is just wrong. (Trust me I have a huge rant saved up about my laundry bag that I will post tomorrow. I just don't have the energy right now.)

And while I suppose there is some degree of recognition to be had that someone would plagerize you for their own benefit. I mean, hey, at least they recognize the quality of the custom. This in no way justifies it.

That being said, I still gotta ask ,"What kind of numbnuts nimrod pays for a custom card that they could recreate with any one of numerous software systems out there for free and use a figure they could find somewhere else, or proxy?" Worst comes to worst they could register here and get all the customs they could want.

I don't mean to belittle any of the custom creators, but why pay for something you could get for free, or virtually free?

It doesn't make sense.

that was/is the problen on the german heroquest the have the sumit from hasbro let ppl dowbnload alle the hq stuff (rules card ect, costume) from thei side. for free but , some thing were stolen and sell on ebay. that fact makes hasbro angry so they if ppl stole it is better to forbid anny thing here the explain.

The only way of effectively solving this problem will be for me to contact ebay, about it being a reoccurring problem, and get set up with a quick way of reporting the auctions as they pop up. I still have a form pertaining to this. I'll try and go back and find it and fill it out. We will not standby and let our users have their intellectual property rights abused.

I am actively taking a role in seeing that this dosn't continue to happen without consequence.

It is a good example of how people who don't know how to make a good HS custom can copy 90% of a good one, and screw it up so bad.

truth - I'm very glad the owner of the HS fan site will fight for us.
That really means a lot, I think, in presenting a strong community front.

Which means unless he has multiple places to use his computer from, or chages his IP address one of many other ways, than he can't reach the site again.

Welcome to the real world. Nothing will stop this type of theft from our community except our own continued vigilance. It is up to those of us that actually care about our community and HeroScape to take notice of these spyjackers when they attempt to usurp the hard work of those within this community that lend their talents to this game we all enjoy. This constant vigilance is not only the work of those that create for the rest of us, but those that use their creations, give feedback to their creations or simply read the new homebrew custom figures. If you go out to eBay and happen upon a card that looks even vaguely familiar ... report it on these boards! It may be that the seller is the member that created it and that is fine and dandy. However, like in this case it may be a stolen card and if so then we as a community can get in there and fight!

Now the accolades for Truth have been fairly abundant and very well deserved, but I would like to take a moment to recognize Skyknight for his vigilance and fortitude to find and help take this spyjacker down hard!

This is the last thing I ever want to see. All because some Lurker trashed things, there is no reason to block all lurkers from viewing customs.

I can understand where you are coming from, but this would be the most detrimental thing that could happen to our community.

If you remember the last time this occured (or, if you weren't around), we had a few people who defended the criminal, and others who were apathetic holding an attitude of 'that's what you get for posting your stuff'. By this time in that thread, IIRC we were already on page 23. You couldn't read the thread fast enough to keep up. You would post a response to the last post and submit it only to find your post actually posted 3 pages later! There were a helluva lot of upset members. Many either pulled their creations, or at least thought very carefully about leaving them. Even today you will see copyrights on the homebrew materials which, in general, is fallout from that incident. The response to that incident back on HQ was indifference from the site owner, the mods did what they could but were not the site owner. Having a response from the site owner makes a very big difference to response in general!

I am sorry but I think 'that's what you get for posting your stuff' is a misrepresentation of the old arguments.

The main point back then was did anyone posting their customs have a valid claim to copyright protection? HQ did not properly address the issue. This site does properly address the issue. Therfore, no disagreements from me, or anyone else it would seem.

Then, as now, I think the stealing of someone elses ideas is a weasel thing to do. The main difference is now truth is doing everything he can to protect from this kind of thing where then GW did not. So in this we are in total agreement.

The moral of my story? Let's let the issues of the past stay in the past and not try and apply them to the issues of today.

Don't forget Ebay does enforce IP/copyright violations. If you report it to them they will take the auction down without dealing with the seller.

It is offensive to most people that are creative, me included. It is one thing to copy something (which if you are making it "your own" I think that is just fine we all need inspiration. But to "carbon-copy" something right down to the letter and call it your own is just dirty, and makes you a yellow bellied liar.
